What Is a Writ of Garnishment?
If you have an unpaid debt that a lender has been unable to collect on, the lender may be granted a writ of garnishment against you.
The term sounds complicated, and it can be scary to find that there is a judgment against you. In the simplest terms, it is a court order which is granted to allow a creditor that allows him to hold or attach the property of the person being garnished. For most people, this means that a creditor is able to take possession of all or a part of a person's paycheck, repossession of property held as collateral, or, in some cases, bank account to help satisfy a debt.
There are some ways to stop this judgment after it has been granted. The person who is being garnished can request that the court file a motion to quash the writ of garnishment - in other words the debtor can ask the court to suppress, void, or set aside the writ for a number of reasons. In most cases, the defendant must show that the order is not valid due to jurisdictional issues or because the claim was made on an unlawful basis. The motion allows the judge to remove the order and stop or prevent the seizure of property or assets.
There are many situations that can result in a garnishment of your wages. Most often, the writ is ordered after a defendant has failed to pay debts like credit cards, car payments, or other longstanding debts.
Once a writ of garnishment has been issued, the debtor's employer will receive a court order to begin garnishing the employee's wages. Because the order is given by the court, an employer has no choice but to abide by the rules of the garnishment order. The best way to prevent having your wages garnished is to negotiate with creditors to make modifications to payment arrangements before the writ is ordered.
Another common reason for a garnishment to be ordered is for failure to make court ordered child support payments. A party who is granted an order for child support by the court who does not receive the agreed upon payments can request a writ of garnishment to help obtain the funds that are owed. The exact circumstances of the garnishment will be determined by the court and placed in a court order. The judgment may allow all funds to be removed at once, or in payments taken out of subsequent checks.
If you have recently received such a court order, understanding what it means to you will help make the process less intimidating. There are several ways to handle a writ of garnishment, but the first step is to find out as much as possible about the debt you are being asked to repay. Try to handle your debts directly with your debtors so that you can pay on your own terms.

Debt Relief: The Different Types Of Programs
Despite being neck-deep in trouble managing finances, a person can still find debt relief programs that can help get one out of hot water. These programs mainly assist individuals in managing a variety of debts that should allow them to get back on their feet. Still, it is a better option to settle debts before they go overdue.
The term debt relief is used to open a variety of options designed to suit one's ability to pay off debts depending on his financial standing. Depending on the type of program selected, such experts aim to resolve financial hardships temporarily which should allow individuals to catch up with their financial obligations. Doing so in the earliest possible time should effectively keep a person's credit account in good standing.
However, if push comes to shove and one would have to seek refuge in one program, there would be four options to choose from. Each has its own pros and cons the bottom line of which is to find means by which a person can go by an effective strategy in meeting his financial dues. The following list below should provide a better understanding of how each program works.
Types of Debt Relief Options
There are four types of debt relief options. These could range anywhere from a self-managed plan that involves a strong determination to tighten belts from overspending to improvised plans by third party companies who act as mediators between a debtor and a creditor.
Self Repayment Plan
If a person does not intend to pay off debts with the use of services provided by debt relief professionals, he can always improvise on his own budget plan. The catch there would be for a person to be able to resist the temptation to spend beyond his dues. It entails a strong determination on a person's end to pay off his debts by making a list of them, knowing which to prioritize, and then paying off. Although this type of debt relief option can have its cons, in more ways than one it is outweighed by its pros. These would be learning how to effectively manage one's finances, being able to pay bills on time, and not having to pay extra for a third party in managing debts.
Debt Consolidation
To put it simply, a debt consolidation program combines several or all of a person's debts into one loan. The good thing about this type of program is it can significantly lower the interest rate of all combined debts. The debtors sole responsibility is to make payments to a debt consolidation company. This company in turn will be responsible for fairly distributing payments to each and every creditor included in the list.
Debt Management
In this type of program, an individual struggling to make ends meet with payment dues seek assistance from credit counseling agencies. These are third parties designated to present structured repayment plans suited for every debtor's needs.
Debt Settlement
A debt settlement in a debt relief program involves negotiating the total amount of all outstanding debts into repayment terms amenable to both parties. Upon reaching a mutual settlement, the repayment terms are then put down to writing and kept as reference.

Debt Settlement As An Option
A fast-becoming popular method in taking care of impossible debts would be the debt settlement program. People sometimes make the mistake of miscalculations when applying for debts and thus end up having difficulty in paying off all debts. When this becomes the case, a person must not try to just avoid calls from his creditors or keep worrying about it. He must find ways by which he can act on a bad debt.
What Debt Settlement is
A debt settlement is a negotiation process with which both parties come to a mutual settlement. This is done in a formal way by actually documenting what both parties have agreed upon. This is best provided by registered government organizations or better yet a debt settlement agency. Before deciding to go with one, a debtor must first check if the agency does not have any negative record in his field of expertise. One can effectively do this by meeting up with potential agencies, presenting your situation and hearing about what the agency proposes to help out with the situation.
Pros and Cons with Debt Settlement
Once a person has started probing more into what the agency can provide, he can also do good by weighing the pros and cons of this program. One of the main things that this program aims to provide is to relieve each debtor with a structured repayment process which also maintains a low monthly repayment amount.
The disadvantage there is would be if a person would have the need to accept a negative impact on his credit scoring. In order to be assured that a debtor maintains a positive impact on his credit scoring, he must make repayments on time at all times. Penalties may be imposed which makes it a must to make payments on time to avoid further consequences.
Debt Settlement Company Function
What usually goes on after signing up for a debt settlement program. The agency actually has to add everything up before negotiating an amount one owes with a creditor. After reaching an agreement, the agency goes back to the creditors to propose an amount. Once this is accomplished, the agency goes back to the debtor, collects the money, and puts it inside an account and doesn't touch on it unless one has been approved to do so.
These companies actually do not act on a settlement unless the account has been delinquent for a month. While this doesn't seem like too much of a trouble, it actually is. The part where payment had been delayed will the be updated charged-off settled or paid settled will never bring the account as good as being commented as paid in full. So the offense stays longer on one's credit card reporting.
Other Alternatives
There are actually ways by which a person can still opt to look into rather than deciding right away to use debt settlement. There's the consumer credit counseling which works simultaneously with a debt management in significantly bringing the interest rate down in one's debt. One can also choose to set up his own repayment plan provided that he has a strong will and determination to pay off debts.

Top 3 Reasons Why You Are in Debt Right Now
There is a big debate happening now whether people or companies are the ones responsible for the recent economic crisis. Some experts suggest that banks have gone so wild by giving unrealistic loans with high interest rates to people who will not be able to afford payment even with very minor hardships. Others emphasize that our culture and living style is the one that got us into this crisis. People are borrowing and spending money more than what their salaries can handle. I definitely believe that if we want our economy to recover, then we must change our spending habits into something healthier and more realistic. While there are probably hundreds or reasons why most of us are in debt today, here are the most common three of them:
1- We've lost our common sense thinking:
I'm not actually a psychology expert, but I can obviously see that we're having a big spending problem. In my entire life, I haven't met a person who doesn't want to live like Hollywood stars. While we all have the right to dream, our dreams must be realistic and proportional to our income. I can see people these days buying unnecessary stuff and then throwing them into the garage after using them only once. Many of them also have 3 or more different cell phones where they only need one. In a nutshell, we should learn to differentiate between what we need and what we want.
2- Job loss:
I hear people always complain about the fact that it's not their fault that they got into debt, and it's actually their boss's mistake when they fired them. I can tell you my friend that nothing is constant, and nothing will last forever. We, humans, have very little control over our surroundings. The smart way of doing this is by not getting loans unless you have a solid job foundation (and even that might not work). If you're not sure that you're in a stable job, then don't take risks by getting huge mortgages or loans that you'll never be able to afford if something goes wrong.
3- We don't track:
I, myself, don't track my spending sometimes especially if they're minor. My advice to you is to track every dollar you spend. If you do your math correctly, then you'll be able to set priorities and probably get rid of your unnecessary spending. Your only way out of debt will be lowering your spending every month until you hit that sweet spot of spending less without affecting your needs.

Debt Settlement Attorney - Do You Really Need One? Find Out The Truth
I have been in the credit card debt relief industry for over a decade now, and have seen many changes take place; some changes that benefit consumers and some that do not. In this article I will discuss the legitimacy, or lack thereof, of the "debt settlement law firm" approach to getting out of debt. Many recent changes in the debt settlement industry have made consumers very confused; this article will open your eyes to the truth of the matter. A fair warning up front this is going to be a long and informative article, so if you're not honestly serious about finding a solid solution to your debt problem then stop reading right now.
Recent FTC Changes
On October 27th 2010, the debt settlement industry was turned upside down by some major changes that the FTC (Federal Trade Commission) had put into place. These implementations by the FTC will change the way debt settlement companies can conduct business forever; and actually are a benefit to the consumer who understands them correctly.
There were two major changes, the first is the advance fee ban, and the second is full disclosure; both being very important topics to understand.
Let's first examine the Advance Fee Ban so you have a good understanding why this was implemented and what it has done to the industry as a whole. The FTC stepped up to take action against the settlement industry after years of complaints from consumers about being ripped off and scammed. Many companies were run by people, who had their own pockets in mind first, not the debtor who needs help.
What attracted so many businessmen to the debt settlement industry was the ability to make quick money with very little work. Prior to the FTC changes companies were allowed to charge their entire settlement fee prior to ever even contacting a creditor to negotiate settlement. Needless to say this caused many problems, and untold numbers of naive consumers were paying large fees upfront only to have the company never finish the job; therefore leaving them in a much worse situation than they were already in.
After years of fielding complaints the FTC finally came down and made it illegal for debt settlement companies to charge fees prior to settling. This is great news for consumers, greatly reducing the risk of entering a debt settlement program; at least where losing upfront fees are concerned.
However for the majority of companies in the industry this was TERRIBLE news; but for the legitimate and business savvy companies it is actually GREAT news. It was bad for all the "scammer" operations; no longer could they just blatantly rip people off, now they had to EARN their money by negotiating good settlements for their clients. Almost overnight you saw over 90% of companies bow out of the industry. Even some honest companies stepped down, simply because they did not have enough operating cash flow to continue conducting business without charging their fees upfront.
For the honest, sound companies in the industry this was good news, because:
A) Now there are legal teeth (FTC regulations) to rid the industry of bottom feeding "scam" companies.
B) It means less competition for them; allowing them to focus on what they do best, save people money and get them out of debt quickly.
The second major implementation on behalf of the FTC was "Full Disclosure". Full disclosure simply means that a representative of a debt settlement company must:
A) Explain all of the various debt relief options available to consumers, not just debt settlement.
B) Fully disclose both the pros and cons of the debt settlement process.
The issue was that many company sales reps would simply lie, or conveniently not inform potential clients about the negative aspects to the settlement process such as: potential lawsuit, creditor harassment, negative credit ratings and that the creditors were not getting paid until settlement (some companies actually deceive people into thinking they are staying current with their creditors during a debt settlement program).
So you may be wondering at this point where I am going with all this and what it has to do with "debt settlement attorneys", just continue on and you will be enlightened.
The Law Firm Fee Loophole & Deceiving Spin!
At this point in time the only way for a debt settlement company to collect a fee for their service is after they reach a negotiated settlement on behalf of their client; and this is the way fees should always have been collected, and thankfully is now the only way to be collected.
However, law firms and attorneys have found a way around this.....for the moment at least. As of right now it is still legal for a "debt settlement attorney or law firm" to collect their fees before they settle your debt. Keep in mind they are not debt settlement companies so therefore the FTC rulings have not affected them yet.
The majority of attorney settlement model programs are very expensive, often times charging a percentage of the overall debt amount a client owes and a percentage of the amount of money saved when the settlement is reached; typically costing more than a settlement company's fee.
There are a few things you must realize about what a debt settlement law firm is trying to sell you on to justify collecting large upfront fees. First they give you the impression that they can actually represent you in court if a creditor were to file suit against you, and second many "claim" to be able to stop collection calls.
For starters if you are being sued by a company outside the state the attorney practices in then they cannot defend you, they can simply refer you to another law firm (by which of course you must pay more legal fees to be defended). Second even if the creditor is in your state the law firm in the vast majority of cases will charge you additional fees to appear in court; making the fact that you paid extra legal fees upfront mean basically nothing.
Additionally while some law firms do send out letters to your creditors to help stop harassment, they cannot actually guarantee you that the calls will be stopped. It's really as simple as that, one of the downsides to debt settlement is creditor harassment; no true way to completely avert that exists.
Now the deceiving spin many sales reps are saying to naive consumers is that their "attorney settlement program" is the only legal approach to a debt settlement program. Which to say the least can be very confusing to consumers, oftentimes paralyzing the consumer with fear of doing anything; especially if they do not have the money to pay the law firm up front.
This is very deceptive of these firms; the only truth in their statement is that they are the only entity who has the LEGAL ability to TAKE YOUR MONEY up front before they settle your debt, and that is the only truth in that statement!
So What Can You Do?
This news may very well leave some people feeling even more lost and unsure about what move to make to alleviate a terrible debt situation. Fortunately I have a few solutions that I can present to you.
The first is an answer to the problem of lawsuit. The majority of people who do sign up with a law firm do so because they feel they are getting some legal protection; therefore eliminating perhaps the single biggest downside to debt settlement.
The reality is lawsuits are a possibility; the creditor has the right to sue for a past due account. The truth is that by far the majority of people going through settlement do not actually get sued; simply because the creditors do not have enough time and money to pursue all the people who owe them money. And the reality is oftentimes even when they do receive a judgment it is still impossible to collect money from some people; the old adage goes "can't get blood from a rock".
Also keep in mind each state has different laws concerning how collectors can pursue lawsuits for credit card debt; with some states like Texas having very debtor friendly laws in place, while others like Georgia do not. BUT there is another solution that enables a debtor to take advantage of the FTC rulings with no upfront fees and still have affordable true legal protection.
This solution is "debt settlement insurance". Some debt settlement companies can refer you to other institutions that can offer an insurance protection program (not available in all states). These plans are typically very affordable and actually provide the necessary legal protection to represent you in court to defend you against the suit; at no extra cost then what the insurance plan cost in the first place.
This really gives the consumer the best of both worlds, therefore offering them an honest way to escape credit card debt and limiting any legal repercussions; all while avoiding having to file bankruptcy.

How to Get Out of Debt Successfully
Getting out of debt is not a very difficult task if you know how to go about it. There are a number of tactics you can use to get out of debt. These include methods to quickly finance your debts and finish payments. These different ways of getting out of debt depend on the type of debt you are in. These debts could be business loans, outstanding bills, student loans among other debts you incur during your daily activities.
The first method by which to get out of debt is through consolidation of all debt loans. Debt consolidation means getting a single loan that will cover all the payments on your debts. This then allows you to concentrate on paying back the single debt loan. This is easier and sometimes you can get an even lower interest rate on the debt loans. Therefore, you get to spend less on the loan repayment than you would if the debts were still outstanding.
You should find the debt consolidation program that suits your needs. There are a number of people and companies which claim to offer help to people get out of debt. However, not all of them are legitimate and some may even be quacks out to con you. Therefore, you should always check a company that claims to offer such services before deciding to use them.
This is because even though these companies may give you a loan to pay off your debts they may be very highly priced. Therefore, when checking out a company always read the fine print. It is not wise to take out debt loans which have very high interest rates since these will only put you deeper into debt. Debt consolidation loans should be flexible for you and have low and manageable interest rates.
You should also not fall prey to companies that ask you to send them advance application fees. When trying to get out of debt you have to be careful not to be so desperate. This could lead you to sending money to such companies in the hopes that they will give you the debt consolidations loans. When checking out a company you should ask in advance if they ask for such advance application fees.
There are certain debt consolidation programs that offer loans to people. These programs do not involve going through a bank but are nevertheless still effective. The reason why such debt consolidation programs are better is because they do not insist on a crystal clear credit record. Most banks insist on checking your credit history and if you have bad credit they may not help you in getting out of debt.
Such programs can help you get unsecured debt consolidation loans at lower and affordable rates. These rates are lower than those offered by banks since they have very low operating costs and expenses. This means you will get bigger debt loans that will cost you way less than you would get in a bank. It is wise to consider such programs when you are trying to get out of debt.
Will The Occupy Wall Street Movement Force Substantive Credit Card Debt Relief?
Despite the impressive attendance figures and a self monitored discipline remarkable for what amounts to a vastly successful non violent flash mob as of yet still without visible hierarchy or organizing principles, the sheer novelty of the Occupy Wall Street approach first disquieted the guardians of the fourth estate. Reporters bound by the traditions of a different age were habitually unsuited to limn the boundaries of an amorphous bottom up philosophy that so inextricably blended logical and detailed requests for, say, meaningful student loan debt settlement legislation with an anarcho Marxist structural foundation, and cable networks hardly knew where to point a camera (and, in so doing, visually label) amidst a roiling membership that saw fashion forward dilettantes and hyper aggressive born instigators marching lockstep with the palpably earnest true believers common to every socially progressive cause in living memory.
From the start, traditional journalists shied away from any sort of thorough investigation or illustration of a movement that consciously resisted easy categorization, and, given the peculiar constraints of their largely outdated code, one almost feels sorry for the esteemed members of the press. Most social activism, after all, attempted to work with the pre-existing media blueprints to facilitate the propagation of simply encapsulated messages and employ catchy slogans tailor made for blurbs and headlines ('No Blood For Oil') as spur toward clearly articulated demands from the government (a withdrawal of troops from the Middle East). With Occupy Wall Street, on the other hand, the endless array of signs foisted about the financial districts of American cities explore a vast range of different remedies that run the gamut of perspectives from orthodox Democrat dogma to radicalized transformative ideological warfare tantamount to an overthrow of the republic.
To a certain extent, of course, the ineffable mish mash of barely articulated demands of the broadly eclectic men and women camping out across the nation appears to be a garish cartoon of progressive excess as complaints contradict one another in succession, calls for action demonstrate a complete ignorance of governmental procedure, and the keening emotions invoked represent the enemy of prudent governmental action or economic maneuverings. As the number of demonstrators to be interviewed by trained reporters engaged by professional news gathering organizations increased, though, and thoughtful and well spoken subjects were singled out for their views (rather than the sensationalistic firebrands and comically naive modern hippies flooding sound bites through the first
week or two of coverage), a certain shared vision for evening societal assets through unilateral debt settlement could be discerned through the haze of personalized messages.
It's important to remember that the men and women filling the streets to promote issues so idiosyncratic or whimsical as to be wholly beyond the auspices of governmental change are somewhat consciously attempting to counter the militaristic unanimity with which the Tea Party fringe of the Republican party has framed the parameters of discourse (for momentary successes whose dependance upon unending legislative gridlock already threatens the security of our financial structure). For that matter, much as the protesters implicitly acknowledge how crucial electoral politics will be for any enduring adjustments, the focus of the Occupy Wall Street movement has always been the multinational corporations and financial citadels that have fueled our culture's addiction to credit card debt and constructed a popular mythology condemning effective methods of credit card debt relief. Avoid bankruptcy privations or the eternal serfdom promised by monthly minimums, the OWS demonstrators shriek in a hundred thousand different voice, and instead allow the one percent a final chance to make amends.

Why Balance Transfer Credit Cards May Be Your Best Debt Relief Option
What a title huh? I know what most people who are reading this are probably thinking rite now, "This guy must be crazy! If I have debt now, why do I need another credit card?". Well, as much as a shocker as this may be, it is 100% possible for many Americans to get the financial relief they need by using a special kind of charge card. This special card account is called a balance transfer credit card account!
Balance transfer credit card accounts are financial products that came about because of the overwhelming competition in the credit card account industry. Banks were forced to create new charge card account products that would be greatly appealing to Americans. Thinking of what would be the best benefit to the average Americans, many banks started creating special credit card account products. These financial products would allow Americans to pay off high interest rate debt with extremely low introductory and long term rates.
This was truly just what many consumers needed. Today, there are so many balance transfer charge card offers that consumers don't have to look to hard to find one that will help their financial situation. When looking for a balance transfer charge card to use as a debt relief option, there are a few things that Americans really should remember. Here are some tips for the search:
#1 First and foremost, the key to using a balance transfer credit card as a debt relief option is choosing an offer that will provide a 0% introductory interest rate for at least 1 year! Introductory interest rates are the big bang when it comes to balance transfer credit card accounts. It is the reason consumers use them so much and can benefit so much from them. So, when searching for a balance transfer credit card account, people should make sure they are getting a 0% for a minimum of 12 months.
#2 Next, make sure to pay attention to the standard interest rate on the account. If the standard interest rates on the balance transfer credit cards are the same or higher than the standard interest rates on the credit cards people are transferring the balances from, after the introductory period, consumers may find themselves in the same position! Always make sure the balance transfer charge card used as a debt relief option has a lower standard interest rate than the one the balance is being transferred from!
#3 Finally, people should pay close attention to any other fees that may be charged! I'm talking about annual fees that can go up to $1,000.00 and offset the savings of having the low interest rates. Also, most balance transfer charge cards will come with transfer fees. Transfer fees tend to be around 5% which is fine as long as Americans get a 0% interest rate for a minimum of 12 months and don't have to pay an annual fee!
Once consumers choose their charge card, the debt relief process is simple. Use apply for the balance transfer charge card. Once approved, use the available credit to pay off higher interest rate accounts. Pay on time and enjoy the low interest rates that your new credit card has to offer!

Learn Ways To End Debt Without Hurting Credit
When we walk down the street, we tend to see happy Americans everywhere without a care in the world. The unfortunate reality however is that the average consumer carries thousands of dollars in credit card account debt. Looking for forms of debt relief that don't have a negative affect on credit scores, a great deal of Americans feel trapped behind the wall of credit card bills that they have to try every month to figure out how to pay! Well, I have some good news for you! There are a couple ways to get a bit of credit card account debt relief that you may not have thought of. The best part is, these ways don't have an adverse affect on credit scores.
The first way that a lot of people have been getting relief from credit card account debt is by using balance transfer charge cards. Although, this will only work for Americans with good to excellent credit, for those who will qualify, the relief provided will be tremendous. The process is pretty simple. All Americans will need to do is look for a balance transfer charge card that provides a 0% interest rate for at least 12 months. Once approved for this credit card, consumers should transfer the high APR debt to the 0% balance transfer card. There are however a few things that Americans should remember when using balance transfer credit card accounts to relieve debt:
1. First, always make sure that the standard interest rate on the new balance transfer charge card account is lower than the standard annual percentage rate on the charge card account the balance is being transferred from. If it is not, when the introductory rate expires, people may find themselves in the same position or worse!
2. Keep an eye on annual fees! Balance transfer credit card accounts tend to have higher annual fees. Always be aware of and agree to the annual fee for any credit card product before making the decision to fill the application
For those who may not qualify for balance transfer charge cards, there is a way for you to get relief without harming credit as well. This is through working with banks. Sadly, Americans have a general thought that banks are huge evil corporations that don't care about their customers. Well, let's be realistic, if this was the case, the banks would have no customers and we would have no banks!
Sometimes, debt relief can be as simple as picking up the phone and calling the charge card account company! When you call, ask to speak with the financial hardship department. In this department, you will be able to discuss your options with a skilled representative. Don't be afraid to pick up the phone and talk to someone that can truly help you!

Can a Government Grant Help You Get Out Of Debt
The economy around the world is suffering and this means that more people have more debt than ever before. Losing a job and not being able to replace it with one that pays the same amount can be devastating. We get comfortable living a certain way and having that paycheck every month gives us security. You feel good about using your credit cards to make purchase because you know that the money will be there to make the payments. When that is taken away it can cause financial hardship on a family.
There are government grants that are available to you. The key is to find the ones that can help you with personal debt. Because the government likes to stimulate the economy with grants you will see many of them available. You will notice however that not all of them are used for debt relief. You will need to prove to the government that you have a hardship with the debt you have. This means that you have no other way to pay it back.
So when asking if a government grant can help you get out of debt you need to know how grants work. Many people and organizations use professional grant writers when seeking money to help them financially. There are professionals who do grant writing for a living. The benefit you can obtain by using one is that they can write the grant the way it should be written. Using someone with years of experience may be worth it so you do not waste time and money trying to get approved on your own.
What you need to do first before trying to apply for a grant is to gather your financial information. Make a list of the debt you currently have. This will help you to know how much money you need to pay off your debts. The government will want to know this information and you need to face it at some point. Remember that most people who get approved for a grant have a need. The more of a need that you have the greater your chances of getting this money to help you financially.
Remember that if you have recently gone through a job loss then you need help with your debt. You have to decide what tool you are going to use to reduce your debt. There are government grants that can benefit you. If you consider this option make sure that you consider using a professional grant writer. At the very least consult with them so that they can guide you on the best methods to getting approved.
Anyone who is struggling financially knows that it can be difficult to make ends meet each month. Finding a solution to improve your debt situation should be your number one goal.

Americas Financial (Behavior) Problem
The land of the free and the home of the brave, we are the United States of America; a country with a debt of 14. 8 trillion dollars.
The estimated population of the United States is 311, 462, 027.
So, this totals each citizen's share of this debt at $47, 685. 85. The National Debt has continued to increase an average of $3. 97 billion per day since September 28, 2007
Is this what freedom is supposed to feel like, 14. 8 trillion dollars owed to others?
According to God's word, the rich rules over the poor and the borrower is slave to the lender (Proverbs 22:7). I know some would say, "we don't need that God stuff, " "that it's all outdated, " but everything looked a lot more free when we were following what He said!
There is something about the word slave and its counterpart freedom that do not go together. Is this what our founding fathers had in mind?
I'm not even sure we have 15 trillion dollars wrapped around our own minds.
To help, here is a little example of what 14 trillion dollars would look like; One dollar weighs about 1 gram. 14 trillion grams weigh 15, 432, 354 tons, which is the same displacement of 154 aircraft carriers.
Well how did we get here?
As a country and individually we got where we are financially one decision at a time. Putting it this way hurts a lot less, and besides we would decide that's crazy to spend 14 trillion all at once. When times are good and the money is flowing we spend and it does not bother us at all. Again, we do this as a a country and individually.
We have the mindset that "It's just money, I can always make more", or the government will say, "Its just their money, we can always tax more".
I have noticed its always easier to spend other peoples money, because you have done nothing to get it and therefore it has no value to you. You give me 20k to go buy you a car I will have you one in a day. If I take my money and buy a car, it takes me a few weeks to find what I want.
Our government does the same thing with our money by bailing everyone out of their mess. It's alright to help someone but do not enable them to do dumb things.
Government is not God. We should not worship it like it is God.
To put it simply, this country has affluenza (affluenza, n. a painful, contagious, socially transmitted condition of overload, debt, anxiety and waste resulting from the dogged pursuit of more. [ 1] Wikipedia)
I have had this virus, as well as anyone else who is human and has had money. If someone is making five thousand dollars a month, they usually spend that amount, if they don't have a plan, or a budget written on paper.
Most of us want to save, but we have created a debt that tells our money where it needs to go before it's even earned.
Lets suppose you are making 5k a month and all of the sudden the economy starts booming and you start making 7k a month. All of the sudden you get exited about what you may be able to do with the extra money. "I will be able to do the things I always wanted to do, go to the places I always wanted to go and buy the things that I always wanted to buy. "
I'll admit, it's a good feeling when you have extra money and the excitement wells up inside of you about the possibilities of your future. We always want that feeling and after we have had it, lost it, and, as is the case now, searched for waysto have it again, we will be happy. That's why when you buy something, like a new car, it's fun and exciting, but after six payments, that feeling is gone and you are looking somewhere else to get that feeling again. Meanwhile, you are still paying the car payments for the next 42 months.
Money and materials were never meant to bring you happiness, they are fun, but they do not hold within them happiness.
OK, you are making more money, you have the cool car you wanted, the boat, and hey, why not a pool? You work hard. The kids want one and you can afford the payments. Oh, and I forgot, you want to include a few extra trips to the beach during the summer. (Yes, I have had the same problem as the rest of America; trying to buy happiness).
Now lets make up something like, oh, the house market collapses.
Well, if that happened I would not be too bad off. I don't sell houses so this should not affect my income.
OK, I see where you are going. Let's say a recession hits and all of a sudden your business slows down. Its payday and you glance at your check you see that you started making 5k again instead of the 7k you had become accustomed to. "Don't panic!, " you say. "I will work a little extra and make it back up. Every thing will be OK next month. "
When this happens our money changes, but our behavior doesn't and we are still in search of the fun we were having two-thousand dollars ago. Lets face it, life happens and negative trends in our economy have always and will always happen.
Dave Ramsey says children do what feels good, adults devise a plan and follow it. So, let's devise a plan to get out of our mess and not to get back in it.
We have briefly described how we got in this situation, so let's look at how we get out. (I am so glad you are asking these questions)
We first have to realize that just because we are Americans, we are not entitled to everything we want. I have to discipline myself. Everything I want will not be good for me. Although I think it might, God always knows better.
You must have a plan (budget) that will get you to your goals. If you want some money for an emergency, you should put that in your budget, so you will have it when the need arises. If you would like some money for retirement or want to send your kids to college, start saving now. If you say, "I will save when I have the money, " you will always find a payment or something "fun" to do with the extra cash. What do you think sounds more fun, being 70 years old wondering how you will pay monthly bills, or being 70 and knowing that you have the ability to cover basic needs without worry?
There is not a right or wrong answer, just a better choice or a better behavior. We need to look at what is more important and where we want to go with our finances, instead of wondering where everything thing went and what went wrong. There will always be recessions and downturns in our economy, so lets plan for them before we get there and they will not be such a worry when we are going through them.
I always ask my clients this, when I am coaching them, "Do you remember what you bought that left you with all this credit card debt?" The answer is always NO, so it must have not been as much fun as they pictured. I don't remember the debt I bought with my credit card either.
You may be thinking that, oh you are one of those people who don't want anyone to have fun. I bet you want us to take a vacation by camping in our backyard. Not true, I would love for you to be able to go on great vacations and have nice stuff, but without payments and without it creating so much stress.
With this lifestyle, you will kill yourself with a job you hate in order to take vacation two, good weeks a year. So America, let's enjoy our life with what counts, our family and friends, not payments and stress to maintain the American dream. Don't trade all of your time and talent, health and joy for a monthly payment and material pleasures that get old and tear up. Do you think you will be on your death bed and say, "I wish I could go buy a jet ski at that introductory rate the bank is offering. Its such a good deal.?"
We have a behavior problem. After all, if our financial problem was a math problem we would never go into debt in the first place!
Create a plan and enjoy what you have. Two thirds of the world would love to have our economy right now the way it is, recession and all. If we change our behavior we will elect people who know how to act with our tax dollars.

Getting Debt Free - Why You Need To Change Your Attitude To Money
Getting into debt can be a sign that you need to change your attitude to money. Mismanaged money will inevitably lead to financial difficulties and these can cause you significant worry and stress if they become overwhelming debts.
Most people get into debts because they regularly spend more than their income. And this is often because they do not budget. Budgeting is the simplest way to manage your money effectively but it will require you to change your attitude to money if you have never used one before. A budget allows you to see exactly what you are spending each month and where - as well as where, and how much you are frittering away. This is the first step to changing your habits and will stop you getting into financial difficulties again.
Budgeting will help you to see the things you might have been able to do with the 'lost' money - such as settling some important debts. Once you realize that this will help you get on a better financial footing, you will find it easier to set future budgets, and stick to them.
Your budget will show you the luxuries you could afford to cut out, saving money. For instance, people often waste valuable money buying expensive coffees from branded coffee chains, or unhealthy foods from fast food restaurants. These expensive habits can be cut out altogether or substituted for cheaper alternatives, such as making coffee at home. This will allow you to save money.
If you like to indulge in retail therapy, you may have unaddressed emotional needs. Spending money when you are feeling depressed, for example, can quickly get you into debt. Spending money can create a brief "feel good" factor and people often speak of "retail therapy". In reality, the brief high which can accompany the purchase of something new, will be outweighed by the long term debt of paying for it. Next time you feel the urge to whip out the credit card, think about whether the item is on your budget. If it is not, do not buy! Find someone to talk to, get a hug or take time to pamper yourself with a hot bath or listen to your favorite music until the buying urge passes.
Choose to take control of your finances. Start a budget, set yourself short financial term goals and long term goals to manage your debts. Make them realistic and then stick to them.
Well managed money can help you live the lifestyle of your dreams. But it is all too easy to fall into financial troubles if you do not keep on top of your budgeting. Your attitude towards money - and debt - will have a huge bearing on the quality of your lifestyle. Decide to take control of your finances. Change your attitude towards money. Plan and stay within budget and you will be well on your way to a debt free life.

Protected Trust Deeds - A Light At The End Of The Tunnel
There are few things worse than the feeling of having debts that you can not pay. While sometimes they are a product of poor decision making, sometimes they are just because of bad luck or timing. Either way, you need to get out from it and stop the harnessing phone calls and such. If you are in Scotland you are in luck.
The reason why people in Scotland are lucky when it comes to debt is that the government has been proactive about helping debt ridden people. This has kept the average amount of debt lower than it is in the rest of the U.K. Also, because the Scottish legal system is independent from the U.K. they have more favorable options.
There are a number of avenues you can take to pay off your bills. Each solution is best suited for certain people with certain financial problems but one of the best solutions is the Protected Trust Deed. These are different from the LILA sequestration which is for people with low income and nothing in the way of assets. It is better and prevents sequestration and almost 9,000 Scots a year take advantage of it.
There is something in England, Whales, and Northern Ireland that is similar and that is called an IVA, Individual Voluntary Arrangement however the Protected Trust Deed is still much better and to understand why you need to understand the Protected Trust Deed more.
Protected Trust Deeds are used as a way of remaining solvent after other avenues have been exhausted. You are trying to repay your unsecured debt but it is just not going to be possible. What happens is that all your unsecured debt is collected together. Notice that this is unsecured debt. This means that your mortgage is not part of this. It is for credit cards, store cards, and unsecured credit lines.
Once these debts are compiled, the future trustee of your Protected Deed Trust will broker out an arraignment that the creditors will be satisfied with and leaving them to write off the remaining debt. It is not ideal for the lenders but they know a little bit is better than nothing.
Once the arraignment is put into place, usually in about six weeks, you will get one one monthly bill. You will stop getting letters and phone calls from the creditors (under penalty of law) and you will the payments for the next three years. That is two years shorter than the 5 years under the U.K.'s IVA.
The Protect Trust Deed does not totally leave you free and clean after it is gone although the debts will be a thing of the past. It will make an impact on your credit. That will follow you for 6 years till that too becomes something in the past. It is still better than totally defaulting on all your unpaid debt.

Things You Should Know To Be Free From Debt
Financial overload is a lot of stress. It hinders your knack of finding solutions to become debt free. There are a lot of options you can choose before you can finally find the right one for you. Hopefully this debt relief article will help you in your search for answers to your financial difficulties.
Be a responsible payer, the earlier you settle your accounts the lesser your chances of being charged with tax loans. Nowadays it is difficult to trust, but your creditors took a risk on you hopeful that you would mutually benefit from the agreement. This is a win-win situation. Your creditors earn from your loan (through the interest) and you will gain a favorable credit report that is very crucial in determining your credit score.
When choosing what credit to use in your financial transactions choose the one that can give you more profit -corporate credit. This type of credit will give you several options to choose from with regard to paying your debts, plus your net worth will boost as you do business deals. Another type of credit is called personal credit, although this system keeps you motivated to pay your creditors it doesn't give you the increase you need for your net value.
It is not a fact that bankruptcy will get you out from debts, in most cases it does the opposite. You might not know the process which happens upon filing bankruptcy. First you will be asked to write a list of all your creditors. Then you will be requested to inform all your creditors through a formal letter reporting that you filed for bankruptcy. The next event that will happen will be a lot more difficult because you will be forced to divulge all your asset information breaking the walls of your private life. Of course there will be a court room trial which is made to investigate your financial restructuring plan which will be attended by a lot of people. Another disadvantage of filing for bankruptcy is the filing fees you need to pay which is around $5, 000. You can decide on how to settle your balance, usually it would take 2 to 5 years for that which you need to pay on monthly installment base.
Many banks in the US have become strict with their laws when it comes to debt settlement. Let me give you a list of some of the banks which would not settle with anyone: Citibank, Amex, Capital One, Discover and the list could go on and on. These are just some of the facts that settlement or relief programs personnel don't want you to know. Another thing they won't be telling you is about their secret charges of up to 15% of your total balance which is really a big amount to waste on them! So be very careful in choosing such programs and always ask them to disclose all possible charges beforehand.
If you are capable to buy assets then do it! It is something that can give you a long term benefit even without putting effort to it after your investment. Let me give you an example: when you purchase a house you can have it rented or live in it or have someone else take care of it. For several weeks or months it will not give you a big profit yet but once you sell it after sometime say 5 years, the value of the house will increase giving you a very big profit! But just a warning, very rich people or even politicians don't name their assets to their names for the sake of security. No one will be able to take away something from you if they don't know you own anything, makes sense!
Hope you find this article interesting and informative. So good luck and have a debt free living...today!

3 Easy Steps to Getting Out of Debt
Debt represents one of the major problems that people face today especially with the current economy. Many people are getting into it for various reasons, but it all comes down to miscalculations. Some experts say that banks are the number one reason our economy has hit rock bottom. However, from my own perspective, I think that people are the main reason of this economic crisis because of many things starting with irrational spending. We live in a very seducing society where everyone has a dream of being able to spend tons of money without worrying of going broke. If we want fast recovery to ourselves as well as our economy, we need to act soon to prevent any further crash. As they say that change begins from the inside and spread from there, here are 3 easy to follow steps to get out of debt fast:
1- Do you have a problem?
They say that admitting the problem is half of finding a solution to it. I noticed that most people in debt don't even realize that they have a financial problem. They think that it's just temporary and things are going to solve themselves soon. What they don't realize is that they are going deeper and deeper in debt until they hit a limit which they can't handle. Basically, if your salary doesn't last until the end of the month, then you're in debt. Realizing the fact that it's only going to be worse is your only way to repairing your financials and by that, your life.
2- Track every penny:
I think the number one reason people get in debt is because they don't track their spending. If you want to get out of debt or not to go into it in the first place, you need to write down every dollar you spend. By the end of the month, you're going to have a detailed report where you can sit and analyze where your money is going and how you can manage your spending more effectively.
3- Act quickly:
As soon as you have that report in hand, you need to select the things that you're not going to survive without. This includes all the necessary things like: food, water, electricity, mortgage payments and similar stuff. If you really want to get out of debt, then you must learn how to differentiate between what you want and what you need. I always try to explain debt relief to people as being like weight loss. With weight, you don't actually notice that you are overweight until you have that red flag raised in front of you. However, one you know that you have a problem, you start cutting out unnecessary food and eat only what makes you survive. Forget about buying cool gadgets just because your friend has bought them. Forget about buying new clothes just because you've seen a discount on the internet. Focus only on cutting off your budget to the minimum until you're in the safe zone. It's true that it's going to take a while (like weight loss does), but at least you won't spend your entire life suffering the consequences if you act quickly.

How Valuable Are These Debt Relief Companies?
Debt relief companies lend a hand to people who are powerless to clear their debt for a long time. Late interest fees on credit card payments had compounded their existing huge liability to the extent that these hapless individuals had no other option but to approach one of them. These companies in turn undertake to get the interest rates reduced and some even get a part of the sum owed as waived. But how far can one go with them? Are there any hidden risks involved in using their services? If you are one of those thinking about using the services of these debt relief companies, you should read more from here...
Remember that debt relief companies are not successful with every client in distress. There are numerous cases where the credit card companies have not agreed to the terms.
Your credit scores could be affected. When you use the services of a debt relief company, you may need to refuse to pay the creditors at times to coerce them to agree to the resolution offer. They may do that in the end, but all of this could dent your credit report. The harmful comments can affect you for a long time.
Many of these companies are plain rip-offs. They will charge you big with their tall promises only to fail in their attempts for one reason or the other. Before settling for one of them, you should get clear answers to at least some of these queries...
Has this company been around for a while? If so, you can talk to someone who has dealt with them before.
Has this company been certified by The Better Business Bureau? Businesses that are confirmed by BBB are found to observe high standards of business practice. Search the BBB for this company and see if ever there were grievances launched against it and if they were resolved on time.
Has this company worked with any of the credit companies you are dealing with now? If they have contracted with any of them before, it becomes easy. They will know all about these credit companies.
After you are done with these queries with a fair degree of satisfaction, you can draw out a strategy to get the maximum of these debt relief companies. Here are some more directives...
Before handing your case to a debt relief company, you should make a complete list of your creditors and the exact amount owed to them. If you do not know where you are, you will not be able to select one suitable only for you. For all you know, you could still pull off without their services.
Study your debt relief choices. Bankruptcies, debt consolidation loans and even debt settlements are dissimilar and require a careful line of tactic for better results. Study the process for each choice. When you have selected a choice, search and compare the fees of a few companies. See if you can get references.

Small Judgments And Debt Recovery
I am not a lawyer, I am a Judgment and Collection Agency Broker. This article is my opinion, based on my experience in California. If you ever need legal advice, please contact a lawyer.
Debts and judgments do not recover themselves. In this article, when the words (judgment or judgment debtor) are used, they mean judgments or debts. Judgments are stronger than debts, and almost all civil money judgments start out as debts.
Compared to debts, there are many more tools available to recover judgments. However, when judgments are too small, many judgment recovery tools become too expensive. Judgment and debt recovery, are somewhat similar - when the amount of money owed is small.
Why recover a small (e.g., $400) judgment? Because there is a strong relationship between the size of a judgment and its enforceability.
The chances of half, of a $400 judgment being recovered with just a little bit of effort are very good. The chances of half, of a million-dollar judgment being recovered (with 100 times as much effort) are about a million times less.
When a judgment is small, it makes sense to contact the debtor by mail and/or by phone, and very politely suggesting they pay it off. Suggest a payment plan. Emphasize how you want to help them to get rid of their judgment debt without any extra hassles or expenses for them.
Instead of being a bill collector, become a polite problem solver. The combination of being nice, then using cheap enforcement procedures only if needed, is a potent combination.
Of course, if the judgment cannot be recovered by calling or mailing letters, you have choices. You can wait and let the judgment accrue interest, record a cheap lien or enforce the judgment with cheap techniques, or return the judgment back to the creditor.
When debtors are poor, maybe you can work out a payment plan, perhaps $10-$20 a month? If you have a judgment, and when the debtor has money but will not pay, even when you are patient and nice, consider a judgment debtor exam in the future.
In a nice way, let the judgment debtor know that they can avoid extra expenses and/or spending hours in court, by setting up a convenient payment plan with you.
Never threaten anyone. It is common sense, to bring up the subject of the debtor satisfying the judgment without consuming more of their time, or incurring any extra expenses for them.
Judgment debtor exams cost money, and such expenses can usually be added to the judgment debtor's debt. Of course, getting personally served with a court order to show up in court, might cause a judgment debtor to find their checkbook.
If the debtor does pay you after you spent extra money, make sure they pay extra to also cover your extra costs, for scheduling and serving the debtor exam, etc.
The bottom line is, a debtor voluntarily writing you a $500 check is much more likely to happen, than them writing a $50,000.00 check.
Every judgment enforcer's dream is to find a big judgment and make a big recovery cheaply and quickly. In this economy, that does not happen often enough to be considered a realistic primary business plan.
For lawyers, there is no doubt that "heart attack letters" from attorneys impress many people. If you are an attorney, you can make money with a polite, yet stern template. By mailing demand letters, you can get many payments for the cost of postage stamps.
It is time to look at smaller judgments, and have the goal of using the powerful tools of being nice, and selling the advantage of satisfying a judgment more often; and use expensive recovery techniques less often.

Negotiating Debt Settlements: What You Need to Know
With so many people struggling to get out of debt, you might have heard about negotiating debt settlements. If you're struggling with credit card harassment and debt collectors calling at all hours and want to get off the debt roller coaster, then this might be a good way to do it. Before you get started, however, you need to know a few things.
What is debt settlement?
Debt settlement is when you call a creditor or debt collection agency and tell them that you don't have "X" amount of dollars to pay the whole debt, but if they agree to consider the case closed and that the debt has been satisfied, you can come up with a smaller amount instead. Many debt collection agencies have actually started to offer the opportunity to settle your debts before you even ask because it's an easier way for them to get their money.
In a perfect world, the collection agency would agree to mark your debt as having been "settled" on your credit report. This isn't nearly as good as showing up "paid" but it can still be beneficial to your overall score. Once in a while, you can actually negotiate your credit report to show as "paid," but this will depend on your creditor.
How can you do it?
You can settle your debts on your own and there are a couple of ways to do it, but you should make sure that you have the funds available to stick with the arrangement you make with a debt collector.
* Determine if you have a certain amount of money to work with or if you will be negotiating payments to be made. If you have a certain amount of money, you will want to decide how much will go to each debt. The idea is to settle as many debts as you can, so don't let one collection agency drive your negotiations to a screeching halt.
* If you will be making monthly payments, you should decide what you can afford. Do not go over this amount, as it will hurt your budget. Keep in mind that many of your debt collectors have been waiting for a while, so if you have to, make them wait a little longer. Debt settlement is a process that might take some time.
* Next, it's time to negotiate with your debt collector. Tell them that you have a certain percentage of the debt, and would like to settle. If they tell you that they cannot settle for that amount, simply tell them thank you and move on to the next debt. Repeat the process until all of your debts are on their way to being settled.
* Get everything in writing. Do not ever send payment without written confirmation of your debt settlement agreement. If you don't get a letter, your creditors don't get the money. This is your hard copy to show the credit bureaus.
There might be more than just four steps to your debt settlement process, but once you work out a budget and make sure that you're ready to settle your debts, you will likely find that many debt collection agencies are more than willing to work with you and you could be well on your way to being debt free.

Debt Advice: Debt Management for Financial Problems
When you carry out an internet search for "Debt Advice" you will see many companies that are offering advice to help you out of financial difficulties. Many of these companies are motivated purely by money and the biggest problem for you is finding debt advice that you can trust.
If you have never dealt with a debt management company before, the best place to start is to follow recommendations from friends or family - the problem with this is that many people are reluctant to admit that they have had financial problems so it is difficult to get such recommendations.
With this in mind here is a list of things that need to be borne in mind when selecting a debt advisor:
Check their credentials - search online for negative reviews and comments. Make sure that they have a land line, check that their office exists.
Excessive pressure - if the financial company that you are talking to tries to apply excessive pressure it is more likely that they are more concerned with their commission than solving your debt problems. A professional debt advisor will take time to understand your individual circumstances and take you through all of the debt solutions that may be open to you.
Biased debt advice - there are many different debt solutions that can be offered to you depending on your circumstances. If you are only being offered one solution it is likely that the debt advisor is more concerned with earning their commission rather than helping you with your problems.
The advice is too good to be true - as in any walk of life if something seems to good to be true it probably is. If you are suspicious of the debt advice that you have been given make sure that the advisor gives it to you in written form so that you have a record of what you have been promised including repayment amounts, number of repayments and the on-going support that the debt advice company will give you.
Unfortunately every year people get into further financial trouble when they act in good faith on dishonest or misleading advice from companies offering debt solutions. If you keep in mind the points here and follow your own instincts and common sense then you should be able to find a debt advice company to help you ease your financial troubles. So get get better solutions for your debts management.

Understanding Debt Factoring and Its Complexities
When many people hear about debt factoring or accounts receivable factoring, many normally wonder what it is. It is normally said that knowing the meaning of something could be of help on how to use it and this must include knowing what accounts receivable factoring is. This process can easily be termed as a way through which established businesses normally sells their accounts at cut-rate cost to a third party. Those companies that obtain the accounts are normally referred to as "factor" and thus the name debt factoring. After the "factor" has obtained the accounts, they normally collect the business debts through a process called factoring. This procedure is normally used by businesses to help them increase their cash flow and this happens as they get cash for the account receivables that are purchased thus receiving cash immediately for this transaction.
Accounts receivable factoring therefore becomes the means by which many companies are able to inject more cash flow for additional operations. This could be helpful to those businesses that have been transacting on credit and are not able to settle their dues owed to their creditors. However, the business must be stable and of a good reputation to use this process for raising more funds. Many retailers and traders normally prefer the use of receivable factoring.
When companies are selling goods to financial firms, banks or even private companies, the company's credit in the market is scrutinized to help make some important considerations. Debt factoring requires that you give out your invoices to "factors" that then become responsible for debt collection. Your factors decide your sales once you have entered into the receivable factoring deal of which the payments could come in within a day or so. This means that you will need to consult the "factors" before disposing or selling your goods.
It will be necessary to understand the term and conditions involved before you can enter into the agreement. This is because the receivable factoring is generally a long term process. It will therefore to have a clear picture of when your debt factoring will be over so that you can be able to either negotiate the notice period or look out for a different one all together.
Debt factoring is always very complex as it involves things such as the reviewing of your financial status and evaluation of your suitability for factoring by the financial institute or bank that you want to work with. At times credit limits could be required and you will have to agree how they are going to work.

Pros and Cons of Debt Settlement - What To Do?
If you are in a position of having to make some very difficult decisions regarding your debt load, you may be caught in the debt settlement debate and not know who or what is right regarding whether debt settlement is a viable strategy or a scam resulting in high fees, ruined credit scores and increased tax liabilities. Frankly, it can be very confusing with credible arguments and credible financial authorities on both sides of the argument.
You should know that doing something other than paying your debts before or when they are due is most likely going to affect your credit rating. The question to ask your self is: "What debt reduction strategy will result in the highest benefit with the lowest cost and least amount of damage to your credit reports?" Some would argue that bankruptcy is the highest cost to pay because it is the most damaging to your credit score and will cost you thousands upon thousands of dollars of increased interest costs and fees in the future - if you can get credit. Others would argue that even though bankruptcy can mar your credit report for years you are given a "clean" start and you can rebuild your credit without the burden of paying off or settling past debts.
So the idea of debt settlement is to be able to substantially reduce the principle amount of debt owed by paying off creditors with a "take it or you may get nothing if I declare bankruptcy" offer that is a small percentage of the balance owed to the creditor. This has worked well for some debtors working with professionals (many times law firms specializing in this service) or even by doing it themselves. The challenge is having or accumulating the funds to make these lump-sum settlement offers to creditors. Sometimes this means accumulating money in a settlement account rather than paying creditors what is owed to them every month. This can and usually means collection calls, lawsuits and damaged credit during the accumulation period, not to mention potentially high fees if a debt settlement firm is hired. This can be a very painful period that sometimes lasts months and months. Oh, and guess what? The tax man may come calling, telling you that you owe taxes on the debt your creditors wrote off. Some argue, rightfully so, that bankruptcy has much less "pain for the gain".
So who should consider debt settlement? My opinion is this strategy is best suited for debtors that absolutely cannot restructure their debt to make it affordable to payoff and bankruptcy is not an option. Also when most of the problem debt is credit card or other consumer unsecured debt. When is bankruptcy not an option? Well when there are substantially valuable or valued assets that would be lost in bankruptcy. Only an experienced and qualified bankruptcy attorney in your state can help you determine if valuable assets on your balance sheet are at risk with a bankruptcy filing. Lastly, bankruptcy is sometimes ruled out for non-financial reasons. Some people find the idea of bankruptcy reprehensible on moral grounds.

Quick Ways To Get Out Of Debt - Are Quick Ways To Get Out Of Debt Actually A Trap?
Looking for quick way to get out of debt is certainly tempting - nobody wants to owe money any longer than they have to - but are the claimed quick ways of getting out of debt really a help or should you be looking at longer term alternatives?
Whether reducing your debt quickly is practical or not depends on two factors: the amount of your debt and your income. Now that sounds like an obvious statement I know, but there's a bit more to it than that. If your monthly income is greater than your monthly debt repayments then the cash you have to spare can quickly bring down certain debts. You should get in touch with those you owe to see where extra payments would be most effective.
For example, twenty dollars a month will likely make very little difference to a mortgage but could radically change a credit card debt - and credit card debt usually caries high interest rates so it's a win-win situation for you - as long as you don't use it as an excuse to go out and buy more on your card!
Unfortunately many people looking for quick ways to get out of debt are caught in that unpleasant spiral where they're just short of their monthly commitments. There's a temptation to take out further loans or credit cards to cover existing borrowing. It's a trap that's all to easy to fall into. Working out interest rates and what you actually end up paying can be very confusing and it's easy to fall for a deal that looks cheaper but where you eventually end up in more debt than before.
If you search the internet you'll find three different approaches to solving this problem, one of them generally in the form of books are videos that you download. The adverts are very convincing. Happy, smiling people who have got rid of mountains of debt in just a few weeks using a "secret" method - which will only cost you $37, or $67, or maybe more. Now to be honest I have never bought any of these "secrets" so I can't tell you if they work or not. I can understand how people with debt problems might be tempted but I wasn't. Maybe I'm just suspicious, you'll have to make your own mind up.
The other two options are more realistic and the first - debt settlement - although it isn't really a quick way out of debt can ease the debt burden. The basic principle is that you do a deal with your creditors to pay them less than you owe them. Sound brilliant, doesn't it. As you might guess it's not as simple as that. First, you need to be in real debt trouble - because they're not going to offer you anything if you're paying normally - no matter how much it causes you to struggle. Then there's the complexity of dealing with all those different companies: car, house, credit cards, etc. There are debt settlement companies who offer to handle it all for you but it may not be a complete solution and even they may not be able to get everybody you owe to agree. It can work - particularly if you are concerned that your only alternative is bankruptcy - but it's not a risk free strategy.
The final solution is debt consolidation, which shouldn't be confused with settlement. Here you take out one loan to pay off all your other debts. In reality it doesn't mean you owe less, and you may take longer to pay it off, but if you end up with a single, much lower payment, it takes the pressure off and simplifies your life. Frequently these are attached to mortgages which in some cases can mean tax advantages too. Really you need to talk to a qualified professional to see if this is right for you because each person's situation is different.
Is it a fast solution to get out of debt? The honest answer is no, not really. The truth is, a quick way out of debt may not be possible. It almost certainly took you time to get into debt in the first place, and it may have been caused but change of circumstances as well. Debt consolidation offers a long-term approach that also makes your life easier and your debt more manageable in the short-term. The fact is quick ways out of debt are often dubious at best and the answer to your problems will perhaps be traditional: slower, but safer.
